Camera SDK Notices

Cloutal Tether (formerly Cloutal Photo Tether) comes in two versions. The version for Canon EOS cameras uses Canon’s EOS Digital SDK (EDSDK); the version for Sony cameras uses Sony’s Camera Remote SDK. Each version contains only its own maker’s SDK. The Canon notices come first; the Sony notices follow.

The version for Canon EOS cameras loads the Canon SDK at runtime and, in an authorized release build, embeds the approved Canon runtime framework.

The notices below are passed through to you as required by the Canon U.S.A., Inc. Software Development Kit License Agreement under which Cloutal licenses that SDK. They apply to the Canon SDK component, not to Cloutal Tether as a whole.

Ownership and proprietary rights

Title to the Canon SDK resides at all times with Canon. All rights in it — including copyright, trademark and trade-secret rights — belong to Canon, and nothing in Cloutal’s licence to you conveys any right in it beyond running it as part of Cloutal Tether. The SDK is proprietary and contains confidential information, including data processing algorithms and concepts. The copyright and proprietary notices delivered with the SDK are reproduced with the component as supplied by Canon and are shown in the app under Legal & Licenses.

Your licence to the Canon component

Your right to use the Canon SDK is limited to using it as part of Cloutal Tether, with a compatible Canon-brand camera. You may not:

• assign, sublicense, rent, lease, reproduce, distribute, convey or otherwise transfer the Canon SDK, in whole or in part, or dispose of it;
• translate it, convert it to another programming language, decompile, reverse engineer or disassemble it;
• disclose the confidential information it contains; or
• use it separately from Cloutal Tether, or with a product that is not a compatible Canon-brand camera.

These restrictions survive termination, and they are Canon’s, not Cloutal’s to waive.

Export control

The Canon SDK is subject to United States export controls. It may not be downloaded or exported into, or to a national or resident of, any country to which the United States has embargoed goods, nor to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or using the Commerce Department’s Table of Deny Orders.

Warranty and liability disclaimer

Required by the Canon agreement and given in Canon’s own words:

No implied warranty as to the quality or performance of the developer kit and software, including any warranty of merchantability or fitness for a particular purpose, is given by Canon U.S.A., Inc., its parent, subsidiaries, affiliates and their respective distributors and dealers, and all such warranties are expressly disclaimed. No other warranty or guaranty given by any person, firm or corporation with respect to the developer kit (including the software) or delivery of the software will bind the Canon parties listed above, or anyone else who has been involved in the creation, production or delivery of the developer kit.

Neither Canon U.S.A., Inc., its parent, subsidiaries, affiliates and their respective distributors and dealers, nor any other person, firm or corporation, is responsible for damages of any nature, including but not limited to loss of revenue or profits, expense or inconvenience, or for any other special, incidental or consequential damages caused by the use, misuse or inability to use the developer kit (including the software), whether on account of negligence or otherwise, or by failure to conform to any express or implied warranties.

Canon U.S.A., Inc., its parent, subsidiaries, affiliates and their respective distributors and dealers will have no obligation to defend or indemnify you in connection with any claim or suit by a third party alleging that the software, accompanying documentation or the use thereof infringes any intellectual property of such third party.

Canon does not maintain, support or guarantee uninterrupted operation of the SDK, and no updates, fixes or support for it are made available through Canon. Support for Cloutal Tether is provided by Cloutal.

Restricted rights

The Software is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure is subject to restrictions set forth in subdivision (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at 48 CFR 252.227-7013, or in subdivision (c)(1) and (2) of the Commercial Computer Software — Restricted Rights clause at 48 CFR 52.27-19, as applicable. Appropriate notices will be applied to all information and software delivered to the Government. The contractor/manufacturer for the technical data and software licensed from Canon is Canon U.S.A., Inc., One Canon Park, Melville, New York 11747.

Cloutal Tether is developed and supported by Cloutal and is not sponsored, endorsed, certified, or supported by Canon. Support is provided by Cloutal, not Canon. “Canon” and “EOS” are trademarks of Canon Inc., used only as nominative references to describe compatibility with selected Canon cameras, subject to the applicable camera, SDK, and macOS support matrix.

Sony Camera Remote SDK

The version of Cloutal Tether for Sony cameras uses Sony’s Camera Remote SDK to communicate with supported Sony cameras. It embeds the Sony runtime libraries in binary form, as the applicable Sony agreement permits, and nothing else from the Sony kit. These notices are the ones in that version’s Third-Party Notices and End-User Licence Agreement.

Use restriction

The Sony Camera Remote SDK incorporated in this Software may be used solely to remotely control or use camera products, and peripheral products such as lenses and flashes, developed or sold by Sony, in normal usage. You may not derive source code from, modify, reverse engineer, decompile or disassemble it, create derivative works from it, separate any of its components, remove or alter its notices, or share, distribute, rent, lease, sublicense, assign, transfer or sell it, except as the Sony agreement expressly permits.

Notice to end users required by Sony

Manufacturer’s warranty. Once a Sony camera or peripheral is used or controlled through this Software, that device may be out of the manufacturer’s warranty, as separately specified by Sony. By using the Software with a Sony device you acknowledge this.

Who made this Software. Sony and its affiliates are not the owner, licensor, creator or developer of Cloutal Tether, and do not provide support for it. Cloutal, Inc. is solely responsible for the Software and for its support.

Sony warranty and liability disclaimers

Sony and each of the third-party suppliers expressly disclaim all warranties, duties or conditions, express or implied, including, but not limited to, the implied warranties of merchantability, noninfringement and fitness for a particular purpose,

except where a user’s jurisdiction does not permit such a disclaimer.

Open-source components inside the Sony runtime

Sony’s kit bundles open-source components that are governed by their own licences rather than the Sony agreement. The version for Sony cameras ships two of them, and their licence texts are reproduced in the app’s Legal & Licenses window:

• libusb (CrAdapter/libusb-1.0.0.dylib): GNU Lesser General Public License v2.1. Distributed as a separate, replaceable dynamic library, as the LGPL requires.
• libssh2 (CrAdapter/libssh2.dylib): BSD-3-Clause. This build of libssh2 statically incorporates OpenSSL, licensed under the Apache License 2.0; the OpenSSL notice applies to it.

OpenCV is included in Sony’s kit for its sample application only and is not shipped in Cloutal Tether. Sony’s own source offer for these components is at oss.sony.net. The licence agreement for the Camera Remote SDK is published by Sony at sony.net/CameraRemoteSDK.
