Camera SDK Notices

Cloutal Photo Tether uses Canon’s EOS Digital SDK (EDSDK) to communicate with supported Canon cameras. The application loads the Canon SDK at runtime and, in an authorized release build, embeds the approved Canon runtime framework.

The notices below are passed through to you as required by the Canon U.S.A., Inc. Software Development Kit License Agreement under which Cloutal licenses that SDK. They apply to the Canon SDK component, not to Cloutal Photo Tether as a whole.

Ownership and proprietary rights

Title to the Canon SDK resides at all times with Canon. All rights in it — including copyright, trademark and trade-secret rights — belong to Canon, and nothing in Cloutal’s licence to you conveys any right in it beyond running it as part of Cloutal Photo Tether. The SDK is proprietary and contains confidential information, including data processing algorithms and concepts. The copyright and proprietary notices delivered with the SDK are reproduced with the component as supplied by Canon and are shown in the app under Legal & Licenses.

Your licence to the Canon component

Your right to use the Canon SDK is limited to using it as part of Cloutal Photo Tether, with a compatible Canon-brand camera. You may not:

• assign, sublicense, rent, lease, reproduce, distribute, convey or otherwise transfer the Canon SDK, in whole or in part, or dispose of it;
• translate it, convert it to another programming language, decompile, reverse engineer or disassemble it;
• disclose the confidential information it contains; or
• use it separately from Cloutal Photo Tether, or with a product that is not a compatible Canon-brand camera.

These restrictions survive termination, and they are Canon’s, not Cloutal’s to waive.

Export control

The Canon SDK is subject to United States export controls. It may not be downloaded or exported into, or to a national or resident of, any country to which the United States has embargoed goods, nor to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or using the Commerce Department’s Table of Deny Orders.

Warranty and liability disclaimer

Required by the Canon agreement and given in Canon’s own words:

No implied warranty as to the quality or performance of the developer kit and software, including any warranty of merchantability or fitness for a particular purpose, is given by Canon U.S.A., Inc., its parent, subsidiaries, affiliates and their respective distributors and dealers, and all such warranties are expressly disclaimed. No other warranty or guaranty given by any person, firm or corporation with respect to the developer kit (including the software) or delivery of the software will bind the Canon parties listed above, or anyone else who has been involved in the creation, production or delivery of the developer kit.

Neither Canon U.S.A., Inc., its parent, subsidiaries, affiliates and their respective distributors and dealers, nor any other person, firm or corporation, is responsible for damages of any nature, including but not limited to loss of revenue or profits, expense or inconvenience, or for any other special, incidental or consequential damages caused by the use, misuse or inability to use the developer kit (including the software), whether on account of negligence or otherwise, or by failure to conform to any express or implied warranties.

Canon U.S.A., Inc., its parent, subsidiaries, affiliates and their respective distributors and dealers will have no obligation to defend or indemnify you in connection with any claim or suit by a third party alleging that the software, accompanying documentation or the use thereof infringes any intellectual property of such third party.

Canon does not maintain, support or guarantee uninterrupted operation of the SDK, and no updates, fixes or support for it are made available through Canon. Support for Cloutal Photo Tether is provided by Cloutal.

Restricted rights

The Software is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure is subject to restrictions set forth in subdivision (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at 48 CFR 252.227-7013, or in subdivision (c)(1) and (2) of the Commercial Computer Software — Restricted Rights clause at 48 CFR 52.27-19, as applicable. Appropriate notices will be applied to all information and software delivered to the Government. The contractor/manufacturer for the technical data and software licensed from Canon is Canon U.S.A., Inc., One Canon Park, Melville, New York 11747.

Cloutal Photo Tether is developed and supported by Cloutal and is not sponsored, endorsed, certified, or supported by Canon. Support is provided by Cloutal, not Canon. “Canon” and “EOS” are trademarks of Canon Inc., used only as nominative references to describe compatibility with selected Canon cameras, subject to the applicable camera, SDK, and macOS support matrix.
