Cloutal Photo Tether Terms of Service

These Terms of Service govern your access to and use of the Cloutal website, the purchase of Cloutal Photo Tether subscriptions or licences, and related services provided by Cloutal, Inc. (“Cloutal”). Your use of the Software is also governed by the licence agreement shown in the app’s Legal & Licenses screen, and your data by the Privacy Policy.
Cloutal Photo Tether is sold by Cloutal. There is no third-party seller or marketplace: your contract is with us, we invoice you, and we are responsible for the Software and for your refund rights. The separate Cloutal Media Terms cover the marketplace, where photographers sell their own work — nothing in them applies here.
1. Acceptance
By using the website or purchasing or activating the Software, you agree to these Terms, the EULA, and the Privacy Policy.
2. Accounts and licences
You are responsible for maintaining the confidentiality of your licence key and account, and for activity under them. Licences are subject to the device limits and terms of your plan.
3. Subscriptions, billing, and cancellation
Paid plans renew per your order until cancelled. Fees, taxes, billing cycles, cancellation and refunds are described in your order and in the Refund & Cancellation Policy.
4. Acceptable use
You must not misuse the website or services, interfere with their operation, or attempt to circumvent licensing or security controls.
5. Intellectual property
Cloutal and its licensors own the website, services and Software. No rights are granted except as expressly stated in these Terms and the EULA.
6. Third-party components and cameras
The Software uses Canon’s EOS Digital SDK and supports selected Canon cameras. Camera manufacturers require certain terms to be passed through to you — covering which hardware the Software may be used with, restrictions on copying, transferring and reverse engineering, ownership and confidentiality of the SDK, and the absence of any manufacturer warranty.
Those terms are set out in full in the licence agreement shown in the app’s Legal & Licenses screen, and they govern. They are deliberately not restated here: a manufacturer’s required wording controls over anything that conflicts with it, so a summary on a web page could only be less accurate than the licence itself. See also Third-Party Notices and Camera SDK Notices. Supported cameras and SDK versions can change when a manufacturer changes its SDK or its licence terms.
7. Disclaimers and liability
The website and services are provided “as is”. To the maximum extent permitted by law, Cloutal disclaims warranties and limits liability as described in the EULA.
8. Termination
Cloutal may suspend or terminate access for breach of these Terms or the EULA.
9. Governing law and disputes
Governing law, the company’s notice address and dispute-resolution terms will be finalized on approval.
10. Changes
Cloutal may update these Terms with a new document version; material changes will be made visible. For help, or to reach us about these Terms, use the support page.
Cloutal Photo Tether is developed and supported by Cloutal and is not sponsored, endorsed, certified, or supported by Canon. Support is provided by Cloutal, not Canon. “Canon” and “EOS” are trademarks of Canon Inc., used only as nominative references to describe compatibility with selected Canon cameras, subject to the applicable camera, SDK, and macOS support matrix.
