Cloutal Preview Terms of Service
Document version 1.0
These Terms of Service govern the use of Cloutal Preview (“the App”), the iPad app that turns an iPad into a photo preview station at an event, and the related services provided by Cloutal, Inc. (“Cloutal”, “we”). Your data is covered by the Privacy Policy.
The App is free and is downloaded from Apple’s App Store. Apple’s standard licence for App Store apps governs your licence to install and use it; these Terms add Cloutal’s own. Where the two conflict about the licence itself, Apple’s governs. Apple is not responsible for the App or for supporting it — Cloutal is.
1. Acceptance
By installing or using the App, you agree to these Terms and the Privacy Policy. A studio that runs the App agrees on its own behalf and is responsible for the stations it sets up.
2. Running a station (for studios)
- Your photos stay on your network. The App reads them from the storage you connect it to, such as your NAS, and shows them on the iPad. It does not upload them, and your storage sign-in is kept in the iPad’s own secure storage.
- You are responsible for the photos you show and for having the right to show them, including the consent of the people in them — and, for anyone under 18, of a parent or guardian — where the law or the event requires it.
- Lock the station. The App’s settings sit behind the iPad’s passcode (or the App’s own station passcode) so customers see the gallery and nothing else. Keep that passcode to your crew, and do not leave the iPad unattended.
- Watermarks are applied as your Cloutal Media storefront sets them. A watermark deters copying; it cannot prevent someone from photographing the screen.
- Cloutal Media is optional. Signing the station in lets it send customers’ favourites to your album, take booth orders, and use your watermark and galleries. That use is governed by the Cloutal Media Terms and your plan, and some features need a particular plan.
- The App is not a backup. It reads your photos; it does not copy or protect them.
3. At the booth (for customers)
The studio running the station is the business you are dealing with. When you star a photo, the studio sees your favourites. When you place an order at the booth:
- You are buying from the studio, not from Cloutal. The order is created on Cloutal Media in the studio’s name, and the studio’s terms of sale govern what you buy, its delivery and its refunds. See the Cloutal Media Terms.
- The iPad never takes a card. You pay on your own phone through Stripe’s secure checkout, or at the studio’s desk.
- The email address you enter is used to send you your order and is shared with the studio for it.
Questions about a photo or an order go to the studio running the booth.
4. What the App sends
Without a Cloutal Media sign-in, the App talks only to the storage it is pointed at and, if paired, to Cloutal Tether on the same network. When signed in, it also sends Cloutal Media a random identifier for the station, which photos were starred, and booth orders with the email address entered. The App contains no advertising, analytics or crash-reporting services.
5. Acceptable use
You must not misuse the App or services, interfere with their operation, or attempt to get around the station lock, watermarks or other security controls.
6. Intellectual property
Cloutal and its licensors own the App and services. Photos shown in the App belong to the studio or photographer who took them; the App gives no one any right to them.
7. Disclaimers and liability
The App and services are provided “as is”. It relies on the venue’s network and the studio’s own storage, so we do not promise that it will be uninterrupted. To the maximum extent permitted by law, Cloutal disclaims all implied warranties and is not liable for indirect or consequential damages or lost sales, and Cloutal does not warrant the photos, conduct or terms of any studio.
8. Termination
Cloutal may suspend access to its services for breach of these Terms. You can stop using the App and delete it at any time.
9. Governing law and disputes
Governing law, the company’s notice address and dispute-resolution terms will be finalized on approval.
10. Changes
Cloutal may update these Terms with a new document version; material changes will be made visible. For help, or to reach us about these Terms, use the support page.
